概要
MAHDIVOへようこそ。
本ウェブサイトおよびオンラインストア（以下「本サービス」といいます）は、MAHDIVOが運営し、Shopifyを利用して提供されています。
本利用規約および本利用規約から参照される各ポリシーは、本サービスをご利用いただく際のお客様の権利および責任について定めるものです。
本サービスにアクセス、閲覧、利用、または商品を購入することにより、お客様は本利用規約および当ストアのプライバシーポリシーに同意したものとみなされます。
本利用規約に同意いただけない場合は、本サービスをご利用にならないでください。
1. 本サービスの利用およびアカウント
お客様は、本サービスを利用するにあたり、居住する国または地域において契約を締結するために必要な年齢その他の法的要件を満たしているものとします。
商品の購入その他本サービスの利用に際し、メールアドレス、配送先、請求先、決済情報その他必要な情報をご提供いただく場合があります。
お客様は、提供する情報が正確、最新かつ完全であり、その情報を提供する正当な権限を有していることを保証するものとします。
アカウントを作成した場合、その認証情報およびアカウント上で行われる活動を適切に管理する責任はお客様にあります。
2. 商品について
当ストアでは、商品について可能な限り正確な説明、画像および情報を提供するよう努めています。
ただし、ディスプレイ、端末設定、撮影環境その他の要因により、実際の商品の色や外観が画面上の表示と多少異なる場合があります。
商品説明、仕様、価格、在庫状況その他の商品情報は、必要に応じて変更される場合があります。
当ストアは、商品の販売を終了し、または特定の国・地域への販売もしくは販売数量を制限する場合があります。
商品が商品ページの説明と著しく異なる場合、不良品、破損品または誤配送の場合は、当ストアのReturn & Refund Policyに従って対応いたします。
3. ご注文
ご注文の送信は、商品購入の申込みとなります。
注文は、当ストアが注文を確認し、必要な決済処理が完了した時点で受け付けられます。
在庫、商品情報、価格、配送上の問題、不正利用の疑いその他合理的な理由により、ご注文をお受けできない場合、または注文をキャンセルする場合があります。
注文内容を確定する前に、商品、数量、サイズ、カラー、配送先その他の情報を十分にご確認ください。
注文確定後、処理、フルフィルメントまたは発送が開始されている場合は、キャンセルまたは変更をお受けできない場合があります。
返品、交換および返金については、当ストアのReturn & Refund Policyが適用されます。
4. 価格およびお支払い
商品の販売価格は、商品ページまたは購入手続き画面に表示されます。
価格、割引およびキャンペーンは、予告なく変更される場合があります。ただし、原則として注文時に表示された価格が当該注文に適用されます。
送料その他の追加料金が発生する場合は、商品ページまたは購入手続き画面に表示されます。
海外配送の場合、配送先の国または地域により関税、輸入税その他の費用が発生する場合があります。
お客様は、購入および決済に際して、正確かつ有効な情報を提供し、使用する決済手段について正当な利用権限を有しているものとします。
5. 配送
商品の処理時間および配送期間は、商品、発送元、配送先、配送方法その他の条件によって異なります。
表示される配送予定期間は目安であり、保証された到着日ではありません。
配送業者、通関、天候、災害、繁忙期その他当ストアの合理的な管理を超える事情により、配送が遅延する場合があります。

6. 知的財産権
本サービスに含まれるMAHDIVOの名称、ロゴ、デザイン、文章、画像、グラフィック、動画その他のコンテンツについて、MAHDIVOまたは正当な権利者が有する知的財産権は、適用される法令によって保護されています。
第三者の商品画像、商標、ブランド、その他のコンテンツに関する権利は、それぞれの権利者に帰属します。
法令により認められる場合を除き、権利者の許可なく本サービスのコンテンツを複製、転載、販売、配布、改変その他商業的に利用することはできません。
7. 第三者が提供するツールおよびサービス
本サービスでは、Shopify、決済事業者、配送事業者その他第三者が提供する機能、ツールまたはサービスを利用する場合があります。
これらの第三者サービスには、それぞれの事業者が定める利用条件またはプライバシーポリシーが適用される場合があります。
当ストアの合理的な管理の及ばない第三者サービスの障害その他の事象については、適用される法令の範囲内で責任を負わない場合があります。

本サービスには第三者が運営するウェブサイトまたはサービスへのリンクが含まれる場合があります。
第三者サイトの内容、正確性、安全性、商品またはサービスについて、MAHDIVOが管理または保証するものではありません。

9. Shopifyとの関係
MAHDIVOはShopifyを利用して本サービスを提供しています。
ただし、当ストアにおける商品の販売および購入に関する取引は、お客様とMAHDIVOとの間で行われます。
Shopifyは、当ストアにおけるMAHDIVOとお客様との売買取引の当事者ではありません。
適用される法令で認められる範囲において、Shopifyおよびその関連会社は、MAHDIVOから購入された商品または取引について責任を負いません。
10. プライバシー
本サービスを通じて取得する個人情報については、当ストアのPrivacy Policyが適用されます。
本サービスはShopifyによってホストされているため、本サービスの提供および改善等に必要な範囲で、Shopifyが個人情報を処理する場合があります。

11. レビュー、フィードバック等
お客様が当ストアにレビュー、意見、提案その他のコンテンツを提供する場合、お客様は当該コンテンツを提供するために必要な権利を有しているものとします。
第三者の著作権、商標権、プライバシーその他の権利を侵害する内容、虚偽、違法、有害、誹謗中傷的または不適切な内容を投稿してはなりません。
当ストアは、法令または本利用規約に違反すると合理的に判断したコンテンツを削除または非表示にする場合があります。
12. 誤記・不正確な情報等
商品説明、価格、キャンペーン、送料、配送期間、在庫その他の情報に、誤記、不正確な情報または記載漏れが生じる場合があります。
当ストアは、適用される法令に従い、これらを訂正または更新する場合があります。
重大な誤りにより注文を履行できない場合は、お客様に連絡のうえ、注文をキャンセルし、必要に応じて支払済み金額を返金する場合があります。
13. 禁止事項
お客様は、本サービスを合法的な目的にのみ利用するものとします。
以下の行為は禁止されています。

・第三者の知的財産権、プライバシーその他の権利を侵害する行為
・詐欺、なりすましその他虚偽または誤解を招く行為

・他のお客様または第三者に対する嫌がらせ、脅迫または違法な行為
・不正な目的で個人情報を収集する行為
・本サービスの正常な運営を妨げる行為
本利用規約への重大な違反が確認された場合、当ストアは適用される法令の範囲内で、本サービスへのアクセスを制限または停止する場合があります。
14. サービスの変更・停止

17. 補償
お客様による本利用規約への違反、法令違反または第三者の権利侵害によって第三者から請求等が生じた場合、お客様は、適用される法令の範囲内で、その行為に起因する責任を負う場合があります。
18. 分離可能性
本利用規約の一部が無効または執行不能と判断された場合でも、その他の条項の有効性には影響しません。
19. 権利放棄および完全合意
当ストアが本利用規約上の権利を直ちに行使しなかった場合でも、その権利を放棄したものとはみなされません。
本利用規約および本利用規約から参照される各ポリシーは、本サービスの利用に関する条件を構成します。
20. 準拠法
本利用規約および本サービスに関する事項は、適用される強行法規および消費者保護法に別段の定めがある場合を除き、日本法に準拠するものとします。

Welcome to MAHDIVO.
This website and online store (collectively, the "Services") are operated by MAHDIVO and powered by Shopify.
These Terms of Service and the policies referenced in them describe your rights and responsibilities when using the Services.
By accessing, browsing, using the Services, or purchasing a product, you agree to these Terms of Service and our Privacy Policy.

However, product colors and appearance may vary slightly from what appears on your screen due to display settings, device characteristics, photography, and other factors.

If an item is materially different from its product description, defective, damaged, or incorrectly shipped, it will be handled in accordance with our Return & Refund Policy.

An order is accepted after we confirm the order and the required payment processing has been completed.

The Services may use functionality, tools, or services provided by Shopify, payment providers, carriers, and other third parties.
Those services may be subject to their respective terms and privacy policies.
To the extent permitted by applicable law, we may not be responsible for failures or events involving third-party services that are outside our reasonable control.
8. THIRD-PARTY LINKS
The Services may contain links to websites or services operated by third parties.
MAHDIVO does not control or guarantee the content, accuracy, security, products, or services of third-party websites.

9. RELATIONSHIP WITH SHOPIFY
MAHDIVO is powered by Shopify, which enables us to provide the Services to you.
However, any sales and purchases made through our Store are transactions directly between you and MAHDIVO.
Shopify is not a party to sales transactions between you and MAHDIVO.
To the extent permitted by applicable law, Shopify and its affiliates are not responsible for products purchased from MAHDIVO or transactions between you and MAHDIVO.
10. PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because the Services are hosted by Shopify, Shopify may process personal information as necessary to provide and improve the Services.

18. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect.

Our failure to immediately exercise or enforce a right under these Terms does not constitute a waiver of that right.
These Terms together with the policies referenced herein constitute the terms governing your use of the Services.
20. GOVERNING LAW
These Terms and matters relating to the Services are governed by the laws of Japan, except where mandatory laws or consumer protection rules applicable to a customer provide otherwise.
